These Terms of Service ("Terms") govern your access to and use of the services, programs, facilities, and website provided by Gustavo Dantas Brazilian Jiu-Jitsu Academy ("GD Academy," "we," "us," or "our"), located at 1848 E University Dr, Suite 108, Tempe, AZ 85281. By enrolling in any program, visiting our facility, or using our website, you agree to be bound by these Terms.
Important Notice
Brazilian Jiu-Jitsu and martial arts training involve physical contact and inherent risks of injury. By participating in any GD Academy program, you acknowledge these risks and agree to the terms set forth below, including the Assumption of Risk and Liability Waiver sections.
By registering for membership, enrolling in a class, attending a trial session, or using our website at gdjiujitsu.com, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
If you are enrolling a minor, you represent that you are the parent or legal guardian of that minor and that you agree to these Terms on their behalf.
We reserve the right to update or modify these Terms at any time. Continued use of our services following any changes constitutes your acceptance of the revised Terms.
Membership at GD Academy is offered on a monthly recurring basis unless otherwise specified. Enrollment is subject to availability and acceptance by GD Academy.
- All new students are required to complete an enrollment form and sign a liability waiver prior to their first class.
- Membership is personal and non-transferable. You may not share, sell, or transfer your membership to another individual.
- GD Academy reserves the right to refuse or revoke membership at its sole discretion, including for violations of the Code of Conduct.
- Class schedules are subject to change. GD Academy will make reasonable efforts to notify members of schedule changes in advance.
- Membership does not guarantee access to specific instructors, class times, or mat space during peak periods.
Monthly membership dues are billed on a recurring basis on the same date each month. By providing your payment information, you authorize GD Academy to charge your payment method for all applicable fees.
- All fees are due in advance of the service period. Failure to pay may result in suspension or termination of membership.
- GD Academy reserves the right to adjust membership rates with at least 30 days' written notice.
- Returned or declined payments may be subject to an administrative fee.
- Drop-in fees, Open Mat fees, and any additional program fees are due at the time of service.
- Open Mat drop-in fees: GD Affiliate — $25 per session; Non-GD Affiliate — $40 per session.
All fees are stated in U.S. dollars. GD Academy does not store credit card information directly; all payments are processed through a secure third-party payment gateway.
You may cancel your membership at any time by providing written notice to GD Academy at least 30 days prior to your next billing date. Cancellation requests submitted less than 30 days before the next billing date may result in one additional billing cycle charge.
- Membership fees already paid are generally non-refundable except where required by applicable law.
- GD Academy does not offer refunds or credits for missed classes, vacations, or personal scheduling conflicts unless a formal membership hold has been arranged in advance.
- Membership holds (pauses) may be available for medical reasons with appropriate documentation, at the discretion of GD Academy management.
- Introductory trial sessions are non-refundable once attended.
Brazilian Jiu-Jitsu and all martial arts training involve vigorous physical activity, physical contact between participants, and the inherent risk of injury, including but not limited to:
- Sprains, strains, bruises, and abrasions
- Joint injuries, including to the neck, shoulders, elbows, wrists, hips, knees, and ankles
- Fractures or dislocations
- Concussions or other head injuries
- Cardiovascular events during exertion
- Skin infections (e.g., ringworm, staph) associated with close-contact sports
By participating in any GD Academy program, you voluntarily assume all risks associated with martial arts training, whether known or unknown, and whether caused by the negligence of GD Academy, its instructors, employees, or other participants.
Release of Liability
In consideration of being permitted to participate in GD Academy's programs and use its facilities, you, on behalf of yourself and your heirs, personal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue Gustavo Dantas Brazilian Jiu-Jitsu Academy, its owners, instructors, employees, agents, volunteers, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you while participating in any activity associated with GD Academy, or while on or about the premises.
This release includes claims arising from the negligence of the Released Parties, to the fullest extent permitted by applicable law.
GD Academy's total liability to you for any claim arising under these Terms shall not exceed the total membership fees paid by you in the three (3) months immediately preceding the claim.
You represent that you are in good physical health and have no medical condition that would prevent you from safely participating in martial arts training. You agree to:
- Consult a licensed physician before beginning any new exercise program, particularly if you have a pre-existing medical condition, injury, or are pregnant.
- Immediately inform GD Academy staff of any injury, illness, or change in medical condition that may affect your ability to train safely.
- Refrain from training if you have a contagious illness, open wounds, or skin infections that could be transmitted to other students.
- Follow all instructor guidance regarding training intensity, technique, and safety protocols.
GD Academy is not responsible for any aggravation of pre-existing conditions or injuries sustained as a result of training.
GD Academy is committed to maintaining a safe, respectful, and inclusive training environment for all students, instructors, and guests. All members are expected to:
- Treat all instructors, students, and staff with respect and courtesy at all times.
- Arrive on time and in clean, appropriate training attire (clean gi or rash guard/shorts for No-Gi).
- Maintain personal hygiene — trim fingernails and toenails, shower before class, and ensure training gear is clean.
- Tap out promptly when caught in a submission and respect your training partner's tap immediately.
- Train at an appropriate intensity level relative to your partner's skill and size — ego-driven or reckless training will not be tolerated.
- Refrain from using profane, discriminatory, or harassing language on the premises.
- Follow all facility rules, including designated mat areas, no-shoes-on-mat policies, and equipment usage guidelines.
- Refrain from teaching techniques to other students without instructor authorization.
Violation of the Code of Conduct may result in removal from class, suspension, or permanent termination of membership without refund, at the sole discretion of GD Academy management.
Students under the age of 18 must have a parent or legal guardian complete and sign all enrollment forms and liability waivers on their behalf. By enrolling a minor, the parent or guardian:
- Consents to the minor's participation in all GD Academy programs and activities.
- Assumes all risks on behalf of the minor as described in the Assumption of Risk section above.
- Agrees to the Liability Waiver and Release on behalf of the minor and themselves.
- Accepts responsibility for ensuring the minor adheres to the Code of Conduct.
- Authorizes GD Academy staff to seek emergency medical treatment for the minor if a parent or guardian cannot be reached.
GD Academy reserves the right to contact parents or guardians at any time regarding a minor's conduct, safety, or participation.
GD Academy may photograph or video record classes, events, and activities for promotional, educational, and social media purposes. By participating in GD Academy programs, you grant GD Academy a non-exclusive, royalty-free, worldwide license to use your likeness in such materials.
- If you do not wish to be photographed or recorded, you must notify GD Academy in writing prior to your participation.
- You may not photograph, video record, or live-stream GD Academy classes, techniques, or curriculum without prior written permission from GD Academy management.
- Unauthorized recording of other students without their consent is strictly prohibited.
All content on the GD Academy website, including but not limited to text, graphics, logos, images, videos, and instructional materials, is the property of Gustavo Dantas Brazilian Jiu-Jitsu Academy or its content suppliers and is protected by applicable intellectual property laws.
- You may not reproduce, distribute, modify, or create derivative works from any GD Academy content without express written permission.
- The GD Academy name, logo, and brand marks are trademarks of Gustavo Dantas Brazilian Jiu-Jitsu Academy and may not be used without written authorization.
Your use of the GD Academy website (gdjiujitsu.com) is subject to the following conditions:
- The website is provided "as is" without warranties of any kind, express or implied.
- GD Academy does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
- You agree not to use the website for any unlawful purpose or in any way that could damage, disable, or impair the website.
- Links to third-party websites are provided for convenience only. GD Academy is not responsible for the content or practices of any third-party sites.
By providing your phone number or email address to GD Academy, you consent to receive communications related to your membership, class schedules, promotions, and academy updates.
- SMS: To opt out of SMS messages, reply STOP to any text message. Allow up to 10 business days to process your request. You may still receive transactional messages related to your account.
- Email: To unsubscribe from marketing emails, click the unsubscribe link at the bottom of any email or contact us directly. Transactional emails related to your membership may continue.
- Standard message and data rates may apply for SMS communications.
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your participation in GD Academy programs shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Maricopa County, Arizona, in accordance with the rules of the American Arbitration Association.
You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, collective action, or representative proceeding.
GD Academy reserves the right to modify these Terms of Service at any time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify members via email or posted notice at the facility.
Your continued participation in GD Academy programs or use of our website after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of our services and cancel your membership.
